Klub Moana pre-order · a Label 3 Limited brand

These terms govern your pre-order of Klub Moana from Label 3 Limited (NZBN 9429052237232), Aotearoa New Zealand ("we", "us"). By pre-ordering, you agree to these terms.
1. What you're ordering
You're pre-ordering Klub Moana sparkling water (330ml aluminium cans) from our 5,000-can pilot production run.
2. This is a genuine pre-sale
The product is not yet manufactured. Your pre-order helps fund the 5,000-can pilot run, and cans are dispatched after the run is completed. This is a genuine pre-sale of a product — it is not an investment, and it gives you no shares, equity, interest or financial return.
3. Refunds
If the production run cannot be completed, you'll receive a full refund, processed within 14 days of us notifying you that the run will not proceed (card refunds then typically take 5–10 business days to appear, depending on your bank). If something goes wrong with your order, contact us promptly and we'll work with you to put it right. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993.
4. Delivery
We'll ship to the address you provide once the run is complete. Our target is to have orders ready to ship within six weeks of the pilot run going into production; delivery timeframes are estimates and we'll keep you updated. Risk in the goods passes to you on delivery.
5. Payment
All prices are in New Zealand dollars and include GST. Card payments are processed by Stripe. By confirming your pre-order you agree to pay the total shown (including any shipping fee displayed at checkout), and you confirm you're authorised to use the payment method.
6. Our ocean promise
7 cents from every can sold is donated to marine conservation, through our partnership with Sea Cleaners. Klub Moana is aluminium only — no plastic bottles, ever.
7. Your responsibilities
You agree to provide accurate information, to use a payment method you're authorised to use, and to use the site only for lawful purposes.
8. Availability and liability
We provide the site and product on an "as is" and "as available" basis. To the maximum extent permitted by law, we are not liable for any indirect or consequential loss. Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 where they apply.
9. Intellectual property
The Klub Moana name, the honu mark and branding belong to Label 3 Limited and may not be used without our permission.
10. Changes and governing law
We may update these terms from time to time; the current version is always the one published here, with the "last updated" date above. These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.
